In 2023, FLASH successfully changed Florida Statute 538, eliminating the hold requirement on precious metal bullion for secondhand dealers. This was a huge win for our industry—one that only happened because we took action.
In 2026, we’ve seen an uptick in out-of-state “roadshow” buyers that do not abide by Florida Statute 538, and we’re turning our attention to ensure that all secondhand business dealings in Florida are held to the same standards.
There’s still work to do, and we can’t do it alone. Laws are constantly changing, and without a strong, united voice, we risk losing the progress we’ve made.

Not sure if you’re a secondhand dealer?
A Florida secondhand dealer is any business or individual engaged in the purchase, trade, or sale of secondhand goods, including precious metals, jewelry, electronics, and other regulated items, as outlined in Florida Statutes Chapter 538. These dealers must be registered with the Florida Department of Revenue, maintain detailed transaction records, and comply with holding periods and reporting requirements to help prevent the sale of stolen property.
